By accessing or using QCare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a clinic, hospital, or other organisation, you represent that you have the authority to bind that entity to these Terms. If you do not agree, do not use the Service.
QCare is a cloud-based clinic queue management platform that enables outpatient clinics to manage patient queues digitally via QR-code registration, a receptionist dashboard, a waiting room TV display, and WhatsApp notifications. QCare is a software tool only. It is not a medical device, does not provide medical advice, and has no role in clinical decision-making.
The Service is intended for use by healthcare clinics, hospitals, and their authorised staff operating in India. By registering, you confirm that you are at least 18 years old and are authorised to operate a healthcare facility or act on its behalf.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@qcare.co.in if you suspect unauthorised access. QCare is not liable for any loss resulting from unauthorised use of your account.
New accounts receive a 14-day free trial with access to the full feature set subject to plan limits. No credit card is required to start a trial. At the end of the trial period, the account will be restricted unless a paid plan is activated. QCare reserves the right to modify or discontinue the free trial offer at any time without notice.
Plans: Paid plans are offered on monthly and annual billing cycles as described on the pricing page.
Payment: Subscription fees are billed in advance. All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
Refunds: All payments are non-refundable. We do not offer refunds or credits for partial months, unused periods, or plan downgrades. If you cancel your subscription, you will retain access to the Service until the end of the current billing period.
Cancellation: You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing cycle.
Price changes: We may change subscription prices with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

As a clinic using QCare, you are the data fiduciary for your patients' personal data under the Digital Personal Data Protection Act 2023 (DPDP Act). You are responsible for ensuring that patient data is collected lawfully and that patients are informed about how their data is used.
QCare acts as a data processor on your behalf. We process patient data solely to provide the Service and do not use it for any other purpose. Patient data is stored in India and is isolated per clinic account via row-level security. No patient data is shared across clinics.

QCare sends WhatsApp messages to patients only when they have explicitly opted in at registration. You must not use QCare to send unsolicited messages. WhatsApp notifications are delivered via Meta's WhatsApp Cloud API and are subject to Meta's own terms and policies. QCare is not liable for delivery failures, delays, or restrictions imposed by Meta or the patient's mobile carrier.
QCare is a queue management tool only. It does not provide medical advice, diagnosis, or treatment recommendations. It is not a medical device and is not regulated as one. QCare has no responsibility for clinical decisions made by healthcare providers or outcomes experienced by patients. All clinical decisions remain the sole responsibility of the treating healthcare professional.
QCare and all associated software, designs, trademarks, and content are the exclusive property of QCare Technologies Pvt. Ltd. These Terms do not grant you any ownership rights in the Service. You retain ownership of all data you upload or generate through your use of the Service.
QCare aims to maintain high availability but does not guarantee uninterrupted or error-free access to the Service. We may perform scheduled or emergency maintenance that temporarily limits access. QCare is not liable for any loss arising from downtime, data loss, or service interruptions.
To the maximum extent permitted by applicable law, QCare Technologies Pvt. Ltd. and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or business interruption, arising from your use of or inability to use the Service.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount paid by you to QCare in the three months preceding the claim.
You agree to indemnify and hold harmless QCare Technologies Pvt. Ltd. and its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights, including patient data rights under the DPDP Act.
Either party may terminate the agreement at any time. Upon termination or expiry of your subscription, your access to the Service will cease. QCare will retain your clinic data for 90 days after termination, during which you may request an export. After 90 days, all clinic and patient data associated with your account will be permanently deleted. QCare may terminate accounts immediately for violations of these Terms without any obligation to retain or export data.
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India. We encourage you to contact us first at support@qcare.co.in to resolve any issue before initiating formal proceedings.
